Delhi HC Chides Petitioner For Wasting Court’s Time, Threatens Him With Costs

The Delhi High Court on Monday has dismissed the plea seeking directions to the Delhi Government to ensure immediate admission/adequate treatment of all patients, having the symptoms of covid-19 as well as other critically ill patients, terming the PIL as ‘devoid’ of material details.

“At the same time, we make it clear that in case the petitioner files another petition equally casually, the petitioner would be subjected to costs for wasting the time of the Court,” said the two-judges bench of Delhi High Court Justice Vipin Sanghi & Justice Rajnish Bhatnagar while hearing the matter through video-conferencing.

The Court was hearing the plea filed by Bejon Kumar Mishra who sought directions to the Government for ensuring the immediate admission/adequate treatment of all patients, having the symptoms of covid-19 (corona virus).  

“After some arguments, learned counsel for the petitioner seeks leave to withdraw the writ petition, which we find is devoid of material particulars. He states that he shall file a better petition with material particulars,” noted the Court in its order.

The plea filed through Advocate Shashank Deo Sudhi had contended that there are several instances reported where the critically covid-19 affected patients were denied their admission by the government hospitals on one pretext or the other. It has also come to the light that one the constable namely Mr Amit Kumar of Delhi police lost his life on account of denial of admission by the two government hospitals, he had said in his plea.

“…there is complete chaotic situation in the government hospitals of NCT of Delhi as there is no centralized communication system available for the purpose of providing the covid-19 related information in terms of the availability of beds and classified doctors for treatment of covie-19 patient so that the covid-19 infected patients may not waste their time in locating the availability of beds and other medical facilities,” said the plea.

The plea had sought immediate establishment of centralized database communication system with unique identified toll-free number for covid-19 suspected/affected patients including other critically ill patients in government hospitals of NCT of Delhi in terms of availability of doctors and beds in the respective government hospitals, so that patients can be allotted/referred immediately to the concerned hospitals where prompt medication can be made available to the covid-19 patients.

Further, it had sought directions for formation of a court monitored committee to look into the denial of treatment of Covid-19 patients including other critically ill patients by the government hospitals of NCT of Delhi and appropriate action may be initiated against the erring government hospitals NCT of Delhi.
