Delhi HC transfers plea to division bench demanding scrutiny of charge sheets from public prosecutors to Delhi Police’s legal division

A single judge bench presided over by Justice Prathiba M Singh transferred the matter after it was informed by the Delhi government standing counsel Sanjoy Ghose that a similar matter is pending before the division bench.

A single bench of the Delhi High Court on Monday transferred to the division bench, a plea seeking directions to the Delhi government to transfer the work of scrutiny of charge sheets from the public prosecutors to the legal division of the Delhi Police. 

A single judge bench presided over by Justice Prathiba M. Singh transferred the matter after it was informed by the Delhi government standing counsel Sanjoy Ghose that a similar matter is pending before the division bench.

The plea filed by Delhi Prosecutors Welfare Association sought directions to the Delhi government to transfer the work of scrutiny of charge sheets from the public prosecutors to the legal division of the Delhi Police. 

The plea said,

“…the work of scrutiny of charge sheets does not fall within the scope of work of the public prosecutors. Even then, the public prosecutors have never been paid any form of remuneration for the work of scrutiny of charge sheets which is an additional work”.

The plea stated that vide decision dated October 22, 2010, the Lt. Governor accepted the proposal of the GNCTD that Delhi Police should have a separate legal cell of its own for the scrutiny of charge sheets.

The plea further stated that in an affidavit dated 25.02.2013, filed by the Delhi government before the High Court of Delhi, it has stated that the work of scrutiny of charge sheets would be gradually shifted to the legal cell/division of the Delhi Police.
