Delhi HC extends time for completion of Arbitration by 6 months due to lockdown

Delhi High Court while hearing a petition filed by Bansal Infratech Synergies Ltd. extended time for completion of Arbitral Proceedings and passing of the Award by a period of six months from 14th April, 2020 in view of lockdown due to outbreak of pandemic disease, COVID-19

The plea has been filed before Delhi High Court with regards to a dispute arose between the parties with respect to the Civil and Structural Works for LLDPE/HDPE for GAIL Petrochemical Complex-II, Pata (U.P.), therefore, the Learned Arbitrator was appointed by this Court vide order dated 16th March, 2018 in Arb.P.No. 842/2017.

The Counsel appearing for Bansal Infratech submitted that the arguments in the matter in question have been concluded. However, the connected matter pertaining to the contract of “LLDPE/HDPE Project” is yet to be heard and looking into the Covid19 Pandemic, the time for completion of Arbitral Proceeding and passing of the Award be extended for a further period of six months.

Whereas, the Counsel appearing for GAIL India after receiving the instructions, submitted that they have no objection with regards to time being extended.

The case was heard by the single judge bench of Justice Rajnish Bhatnagar while allowing the petition directed that “With the consent of the parties, the time is extended for completion of Arbitral Proceedings and passing of the Award by a period of six months from 14th April, 2020.”
