Delhi HC Grants Rs 30 Lakh of Damages to Microsoft, Adobe & Quest Software

The Delhi High Court on Tuesday awarded damages of Rs. 30 Lakhs to the software giants Microsoft Corporation, Adobe Systems Incorporated and Quest Software in a plea filed against a company named ‘Chetu’ for allegedly using the unlicensed / pirated version of the software programs such as Microsoft Active Directory, SQL Server and Microsoft Windows for its functioning, Quest TOAD for working on projects and Adobe reader 9.0, Adobe Photoshop, Adobe Reader and Adobe Flash. 

A single-judge bench of Justice V. Kameswar Rao of Delhi High Court while pronouncing the judgment through video conferencing observed the dispute is not between the plaintiff No.1 and 3 with the parent company of defendant No.2 but between the plaintiffs and the defendants. Further, the unauthorized usage of the software of the plaintiffs is in India and the plaintiff No.2 is based within the territorial jurisdiction of this Court for the plaintiffs to file the present suit in this Court.

The Three tech giants moved to the Delhi High Court against a company named ‘Chetu’ rendering IT Services to its clients for allegedly using unlicensed and pirated software of the Microsoft Corporation, Adobe Systems Incorporated, and Quest Software.

The tech giants received information on their Business Software Alliance (BSA) website reporting the usage of unlicensed / pirated software programs of the plaintiffs by a company operating by the name ‘Chetu’ located in Nehru Place.
