Delhi HC Orders Police To Take Action Against Jail Officials For Harassment

The Delhi High Court on Wednesday while dealing with the writ petition filed by a Prisoner of Central Jail in Rohini, New Delhi, directed the Jail Superintendent to look into his complaint of being ill-treated or harassed by other inmates in collusion with Jail officials.

A Single Judge bench of Justice Rekha Palli heard the matter through video conferencing, filed by under-trial prisoner “Karan Aias Kalyan” in which he had sought directions to the respondent “State of NCT of Delhi” to ensure protection for him, currently in Central Jail, Rohini, New Delhi.

Learned counsel for the petitioner submitted before the Court that the petitioner is under trial in FIR under Section 307 r/w Section 34 IPC registered on 22.04.2019 in Police Station of Saket and is presently lodged in Central Jail 10, Rohini Delhi. He further added that the petitioner’s family has recently learnt through one Mukesh, who was released from the same jail on 04.05.2020, that the petitioner is being threatened and ill-treated by another prison inmate namely one Saddam Gori, in collusion with some jail officials, namely Subhash, Nitin Bhardwaj and Naidu.

Kamna Vohra, learned ASC, who appeared on advance notice, opposed the petition and said that there is nothing to support the bald allegations made therein.

Therefore, Delhi High Court held that, “Even though there is merit in Mr.Vohra’s submission that the allegations levelled by the petitioner are wholly unsubstantiated, in the interest of justice the Jail Superintendent, Central Jail, Rohini is directed to look into the petitioner’s complaint and in case it is found that the petitioner was/is being ill-treated or harassed by Mr.Saddam Gori or any jail officer, appropriate action be taken against them and necessary protection and medical treatment be given to the petitioner”.
