The Delhi High Court on Wednesday denied bail to a 1.5 Crore ATM robbery accused, he has been also alleged for shooting the Guard at the ATM.
The petitioner Rizwan Iqbal was seeking interim bail for 45 days on the ground that he has to take care of his father who has recently come out of quarantine because he was suspected of suffering from COVID 19 and is an asthmatic patient.
Advocate Amjad Khan appearing for applicant said that petitioner’s father was already quarantined for seven days and after passing of next seven days, there may be a change of circumstances, and, that now since the report of petitioner’s father is negative, the petitioner may be released on interim bail to take care of his ailing father aged 65 years and to meet the financial needs of the family by taking over his father’s business of selling fruits and vegetables.
Additional Public Prosecutor Mr. Panna Lal Sharma appearing for the state while opposing the interim bail contended that a similar bail application of Rizwan was rejected by this Court and was also not interfered with by the Supreme Court in the Special Leave Petition.
Acting upon the plea, the single-judge bench of Justice Brijesh Sethi hearing through video conferencing observed that there are allegations against the petitioner in the instant FIR that he along with his co-accused had looted an amount of Rs.1.5 crores and shot the Guard of the cash van outside City Bank ATM at Kamla Nagar, Delhi. The court also observed that the allegations are of serious nature.
Justice Sethi while dismissing the interim bail application noted that Rizwan has a 26-year-old brother, who can also take care of his father.
