Delhi High Court order Advocates to wear white bands, allows interns to attend hearings in black tie, coat and pant

The Delhi High Court has told that all the lawyer who appear before the Supreme Court, High Courts or district courts must mandatorily wear white bands while the law interns can come to courts wearing black tie, coat, pant and white shirt.

The Delhi High Court Justice Prathiba M Singh said that as per the resolution passed by the Bar Council of Delhi (BCD) black tie, coat, pant and a white shirt is mandatory for interns, the circular of the Shahdara Bar Association (SBA) however saying that interns should wear blue coat would not survive.

This was said by the justice whole she was hearing a plea by a a second-year law student named Hardik Kapoor who had challenging the circular issued by SBA.

On December 1, an order was passed by the court which had put a stay on the resolution and directed the BCD for having a all bar association meeting in the national capital and other stakeholders, for reaching a consensus on what uniform, law interns should wear.

Today, the court was apprised that the BCD has passed a resolution on December 16 which mentions black tie as a distinguishing feature for interns.

Petitioner was represented by Advocate Ujwal Ghai who said that the SBA circular is without authority of law as the formulation of rules regarding the uniform of lawyers and interns is the prerogative of the Bar Council of India and Bar Council of India has already made the Rule 27 of Bar Council of India Rules of Education, 2008 which is currently in force.

The Bench after hearing the case said that in view of the resolution passed by the BCD, the SBA circular would not survive.

The Court, therefore, dispose of the plea.
