Delhi High Court disposes of plea related to advertisement of liquor after hoardings removed by company

The Delhi High Court today disposed of a petition seeking directions to remove the advertisements pertaining to consumption of alcoholic drinks, allegedly in violation of the legal framework applicable to the region of National Capital Territory (NCT).

During the hearing, petitioner-in-person Advocate Dhruv Chawla submitted that the hoardings have been removed.

The Bench comprising Chief Justice D. N. Patel and Justice Jyoti Singh disposed of the petition, saying that the grievance of the petitioner has come to an end. The liberty is reserved with the petitioner to move an appropriate authority in case of any difficulty, it added.

On May 3, the Court issued notice in this petition and sought the response of Delhi Government, New Delhi Municipal Council and Pegasi Spirits Pvt Ltd, which had put up its hoarding across the NCT region whereby its product Pegasi, being an alcoholic beverage, was publicised. 

The plea had alleged that despite the representation made to the authorities as to why this practice has been approved, no reply was filed by them, forcing him to moved to the Court.

The plea argued that advertisers for the longest period of time have attempted to circumvent the law by employing numerous tactics in order to advertise their alcoholic products.

“Advertising alcoholic beverages has been made illegal in India in furtherance of the directive principle stipulated under Article 47 of the Constitution of India, 1950 which directs the State to raise the level of nutrition and the standard of living and to improve public health as among its primary duties and, in particular, the State to endeavour to bring about prohibition of intoxicating drinks and drugs which are injurious to health, said the plea.
