JeM conspiracy case: Delhi High Court agrees to hear plea of Ishfaq Ahmed on March 24

The Delhi High Court has today decided to hear on March 24, a petition filed by Ishfaq Ahmad Bhat, who has been convicted and sentenced to life imprisonment in the Jaish-E-Mohamad Conspiracy Case by the NIA Court in Delhi.

The life imprisonment has been given to Ishfaq for various offences under IPC and UAPA.

In the hearing today, the Counsel for Ishfaq said that the present matter was based on the same First Information Report (FIR), same RC, and same order which was passed by the bench in other connected appeals. He requested for the matter to be de-notified.

The Division Bench of Justice Siddharth Mridul and Justice Talwant Singh re-notified the matter for March 24 along with the connected appeal matters, after noting all the points made by the Counsel.

The NIA Court in November 2022, had sentenced Ishfaq to life imprisonment, rigorous imprisonment, and fine. He was sentenced under Sections 121A, and 120B of IPC and Sections 18, 19, 38, and 39 of the UAPA.

The division bench has also issued notice to NIA in an appeal filed by four convicts namely, Bilal Ahmad Mir alias Billa, Muzaffar Ahmad Bhat alias Muzaffar Bhat, Mehraj-Ud-din Chopas alias Mehraj, and Sajad Ahmad Khan, who were also sentenced by the NIA Court, Delhi in November 2022 for life imprisonment in the Jaish-E-Mohamad Conspiracy Case.

Bilal Ahmad Mir has been awarded life imprisonment (rigorous) and  fine under section  121 A, 120 B IPC, 18, 38, 39 Unlawful Activities (Prevention) Act and 120B IPC read with Sections 4, 5 of Explosives Substances Act.

The second convict is Muzaffar Ahmad Bhat has been awarded life imprisonment, RI, and fine u/s 121 A, 122, 120 B IPC, 18, 23, 38, 39 UA (P) Act, and Section 4 of Explosives Substances Act.

Third Convict Mehraj-Ud-din Chopan@ Mehraj was awarded life imprisonment (rigorous) and fine u/s 121 A, 120 B IPC, 18, 38, 39 UA (P) Act and Sections 4, 5 of Explosives Substances Act.

The last convict Ishfaq Ahmad Bhat was convicted u/s 121 A, 120 B IPC, 18, 19, 38, 39 UA (P) Act and punished with life imprisonment, RI, and fine.
