Delhi High Court protects personality rights of actor Anil Kapoor, restrains use his image, name, voice without consent

Justice Prathiba M Singh passed the ex-parte interim order against websites and platforms that misused the name, image, voice and other attributes of actor Anil Kapoor including the catchphrase “jhakaas” for commercial gains.

Kapoor was represented Advocate Pravin Anand, who said that websites and platforms misused the personality rights of the actor.

The counsel said that the there has been unauthorised sale of forged autographs, morphed images and fake letters along with other things of the cine star of yesteryears Anil Kapoor.

This is not the first actor to have filed complaint.

After Amitabh Bachchan,the actor-producer Anil Kapoor has taken legal action to safeguard his Publicity/Personality rights.

Anil Kapoor had filed a suit requesting a permanent injunction against the unauthorized use of his name, voice, signature, image, or any attribute exclusively linked to him for commercial or personal gain without his consent.

In his plea, the actor cited hundreds of films and web series in which he appeared along with several prestigious awards. His lawyers argued that his name and persona apart from having immense commercial value is also liable to be protected against misuse on the internet.

As evidence of misuse, he cited examples of the sale of t-shirts with his images, people squatting on IP addresses with his name, and even pornographic material using deep fakes.
