Delhi High Court questions journalist on retweet calling Indian Judiciary biased

The Delhi High Court has asked the journalist and writer Abhijit Iyer-Mitra if the restoration of his twitter account be considered when he has retweeted a tweet stating Indian judiciary biased, unaccountable and self-serving.

Justice Prateek Jalan who was part of bench said that Abhijeet seems to have faith in the judiciary of this country when it comes to asserting his own rights otherwise…

The Bench also asked if Abhijeet knows about the implication of retweeting a tweet of this nature and whether it has any consequence on his right of an equitable injunction in his favour.

The Delhi Court was hearing a suit filed by the journalist Iyer-Mitra who wanted access to his Twitter account after been locked out for putting a tweet about the Supreme Court granting bail to Alt News co-founder Mohammed Zubair.

The judges noted that Abhijeet Iyer-Mitra had retweeted a tweet by one Lalitha Kumaramangalam which made certain remarks against the judiciary.

Advocate Raghav Awasthi who represented Abhijeet said that personally, he does not agree with such a view and it is his sense that retweets are not an endorsement.

The counsel added that the retweet was not the subject matter of the suit and that he will obtain instructions from his client.

Justice Jalan said that unfortunately, his eyes have fallen on the tweet, and that Iyer-Mitra will have to justify his own actions.

Adding to the earlier points, the Court said that although the summons are issued, we are yet to file response in the matter.

The Court was also informed that even though summons have been issued, Twitter is yet to file its response in the matter.

The counsel who represented Twitter’ said that due to the change in ownership of the social media giant and the ensuing layoffs, there has been some delay in filing the response.

Th Court has thus granted Twitter four more weeks to file its response and matter has been listed and listed for further consideration on February 16, 2023.
