Delhi High Court rejects Pakistani woman plea seeking long-term Indian visa

The Delhi High Court has refused to entertain a petition filed by a Pakistani woman, married to an Indian citizen, seeking a long-term visa in India.

Petitioner Sheena Naz had applied for a long-term visa on April 23. On April 24, following the Pahalgam terror attack, the Union government decided to suspend visa services to Pakistani nationals and directed them to leave the country before April 27.

The petitioner moved the High Court for consideration of her long-term visa application, along with a direction not to suspend her residential permit, valid from March 26 till May 9.

The single-judge Bench of Justice Sachin Datta on Saturday observed that prima facie, the order issued by the government under Section 3(1) of the Foreigners Act, 1946, did not warrant any judicial review given that the issuance of the same was impelled by serious national security considerations.

In a special hearing on Saturday, the High Court said that it was also not within the province of this Court to carve out any exception(s) thereto.

Following the High Court’s disinclination to entertain the plea, the Counsel representing the petitioner withdrew it.
