Delhi High Court stays Delhi government order to refund excess fee charged by schools

New Delhi (ILNS): The Delhi High Court has stayed the March 19, 2020, order of the Delhi government which asked schools to refund fees charged in excess, as assessed by the Fee Hike Committee in terms of the recommendations dated December 3, 2019, being a part of the report dated February 19, 2020, till further orders.

A divisional bench of Justice Hima Kohli and Justice Subramonium Prasad while hearing the matter through video conferencing has accepted the bank guarantee offered by the School to the extent of 75 percent of Rs.91,65,043, directed to be refunded to the students.

The petition has been filed by General Raj S School and others seeking quashing of the order issued by the Delhi Government.

Advocate Vedanta Verma appearing for the petitioners submitted that petitioners are willing to offer a bank guarantee to the extent of 75 percent of Rs 91,65,043, directed to be refunded to the students and subject to thesame, requested that operation of the impugned orders to be stayed.

Advocate Farasat and advocate Bharat Gupta, appearing for Government of NCT of Delhi stated that they have received an advance copy of the petition. “Counter-affidavit be filed within four weeks. Rejoinder, if any, be filed within four weeks thereafter”, they added.

The bench has issued notice and stayed the operation of the impunged till further orders.
