Delhi High Court tells Delhi Police to create ballistics database

The Delhi High Court has directed the Delhi Police to explore the possibility of creating a database, where ballistic reports of all firearms can be stored, with regards to their  licences and issuance to the public.

A Single-Judge Bench of Justice Sanjeev Sachdeva passed the order on January 10 on a bail application filed by Sourabh Magoo alias Sunny in 2018, seeking bail in the FIR under Section 25 of the Arms Act at Police Station Nabi Karim.

Dhirender Kumar Singh, DCP (Legal) Delhi Police, attended the hearing through video-conferencing. He submitted that one of the issues noticed by the Court with regard to overheating of the motorcycle has been resolved and general view of the riders was that the issue was not such that it may hamper their riding or patrolling. Accordingly, the said issue wa closed .
With regard to the suggestion of the Court of installing GPS devices in licensed weapons, he informed the High Court that the same was examined by a Committee appointed by the Commissioner of Police and the Committee is of the view that keeping in view the technical, financial and privacy concerns, the same may not be a feasible option.

The Court, while noting that the status report stated to have been filed is not filed, directed the  counsel to check up with the Registry and have the same placed on record.

“The Committee appointed by the Police Commissioner referred to above, may also examine the possibility of creation of a Ballistic Database, where ballistic reports of all firearms, in respect of which licences are issued or which are endorsed on the licences issued to public, can be stored so that said database can be accessed in case of an investigation”

-the order reads.

It is directed by the Court that the Committee may also consult the technical experts of CFSL with regard to the same.

The High Court has listed the matter on April 8, 2022 and asked to file a fresh status report before the next date of hearing.
