Delhi Police says did not find any incriminating evidence against man who called Mohammed Zubair jihadi

The Delhi High Court was informed by the Delhi police that nothing incriminating could be found about Jagdish Kumar who called Alt News journalist Mohammed Zubair a ‘jihadi’ and said that once a jihadi is always jihadi.

The Delhi police in their report mentioned that Jagdish Singh was inquired about his intentions but nothing incriminating came out to proceed further in the matter.

The report by Delhi Police said that no case has been registered against Jagdish Singh as the tweets by him do not cause any fear or alarm to the public.

The reports reads that the captioned tweet by complainant Jagdish Singh and his examination in this regard has revealed that the captioned tweet on 18.04.2020 does not cause fear or alarm to the public or any section of the public whereby any person may be induced to commit an offence against any state or public tranquility.

The report stated that in view of the above, no case has been registered in relation to the captioned tweet against the complainant i.e. Mr. Jagdish Singh.

The report was filed by the Delhi Police report after the High Court pulled up the police for failing to act against Singh and instead filing a first information report (FIR) against Zubair.

The matter pertains to a tweet by Zubair where he has called out Singh for being a troll and retweeted his display picture, which featured his daughter but after pixelating/ blurring the daughter’s image.

Subsequently, Zubair was booked by the Delhi Police under the provisions of the Protection of Children from Sexual Offices (POCSO) Act as well as relevant Sections of the Information Technology Act and the Indian Penal Code for allegedly “threatening and torturing” a minor on Twitter.

An affidavit was filed by police before the High Court saying that it has not named Zubair in the charge sheet because it did not find any criminality against him.

However, the High Court pulled up the Police for failing to act against Singh who had made “hate speech” against Zubair.

Justice Anup Jairam Bhambhani said that the Court would not be doing its duty if no action was taken against Singh for making hate speech against Zubair.

The High Court noted that the Delhi Police went hammer and tongs against Zubair. But the case has now ended in a whimper as it should have because there was no evidence against him. It asked the Counsel appearing for the Delhi Police as to what action it took against Sinhh.
