File charge sheet against Sharjeel Imam before January 9: Delhi High Court to Delhi Police

The Delhi High Court on Wednesday directed the Delhi Police to file a charge sheet in the case related to former JNU student Sharjeel Imam, arrested under the Unlawful Activities (Prevention) Act, in connection with the Delhi Riots 2020, before the next date of hearing in the case.

The Counsel appearing for Imam requested the Bench of Justice Siddharth Mridul and Justice Rajnish Bhatnagar to give the next date of hearing in the case.

Appearing for Delhi Police, Special Public Prosecutor (SPP) Amit Prasad asked the High Court to issue an order for filing of charge sheet in the case.

The High Court then fixed January 9 as the next date of hearing in the case and issued order to the police to file the charge sheet.

Earlier on Tuesday, Additional Sessions Judge Amitabh Rawat of Karkardooma Court had granted time to Delhi Police till January 2 to file a reply on Imam’s petition seeking resumption of inmate phone calling facility provided to him in Tihar jail earlier. 

Sharjeel sought resumption of inmate phone calling facility provided to an accused/applicant under Rule 629 of the Delhi Prisons Rule, 2018 since he had been lodged in judicial custody.

The facility was stopped in September after a circular was issued by Jail authorities.

Moved through Advocate Ahmad Ibrahim, the petition stated that the facility was stopped by the jail authorities without any reason or providing any opportunity for the Applicant to oppose the same and the same has not been resumed till date.

Imam was arrested in January, 2020 in connection with several cases registered in connection with an alleged inflammatory speech delivered by him during the anti-CAA protests in the national capital.

He was named as an accused in the larger conspiracy case under stringent provisions of the Unlawful Activities (Prevention) Act in the supplementary charge sheet filed in November, 2020.
