The Allahabad High Court has given relief to the husband in a dowry harassment case by staying hearing in the case. A report has been sought by the court sending the matter to the mediation centre. Till then, the hearing of the dowry harassment case between Anju Kushwaha vs Ashish Kumar, going on in Kanpur Dehat, has been stayed.
A Single Bench of Justice Om Prakash Tripathi passed this order while hearing an application filed by Ashish Kumar Maurya.
The application U/s 482 CrPC has been filed by the applicant with a prayer to quash the entire proceedings of Complaint Case under Sections 498-A IPC and 4 Dowry Prohibition Act, 1961, PS- Akbarpur, District Kanpur Dehat.
The counsel for the applicant submitted that the applicant has deposited a sum of Rs 25,000 in compliance with the order dated 07.04.2022.
The matter is referred to the Mediation Centre, High Court, Allahabad.
The Court directed that the Mediation Centre shall proceed in the matter expeditiously. Thereafter the case shall be listed on 26.09.2022 in additional cause list. Mediation report will be filed prior to the date fixed.
“Till the next date of listing, further proceedings against the applicants in Complaint Case No 1372/2019 arising out of Misc Case No 84/2019 (Anju Kushwaha Vs Ashish Kumar) under Sections 498-A IPC and 4 Dowry Prohibition Act, 1961, PS- Akbarpur, District- Kanpur Dehat, shall be kept in abeyance,” the Court ordered.
