The Gauhati High Court has recently directed the Deputy Commissioner, Hailakandi to pass a speaking order on petitioner’s representation regarding implementation of government schemes in Hailakandi District.
The Division Bench of Chief Justice Sudhanshu Dhulia and Justice Soumitra Saikia disposed of a Public Interest Litigation (PIL) filed by a society (Axom Premi Yuba Chatra Samaj) through its president Imdadul Haque Barbhuiya .
The grievance raised by the petitioners is that there are certain government schemes, including schemes under the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (MGNREGA), which are not being followed properly in Hailakandi District.
Several representations have been made to the relevant authorities, from the Block Development Officer, Hailakandi Development Block to the Deputy Commissioner, Hailakandi, but in vain. Thus, the petitioners have filed the PIL seeking appropriate directions from the High Court for implementation of these schemes.
At this stage, the Court observed that since the representation of the petitioners is already pending inter alia with the Deputy Commissioner, Hailakandi, dated 26.08.2021, the Court disposed of the petition with a direction to the Deputy Commissioner, Hailakandi to hear the petitioners through their representation.
“The petitioners shall file another representation before the Deputy Commissioner annexing the entire copy of the writ petition therein and the Deputy Commissioner shall pass a speaking order thereon within six weeks thereafter,” ordered the High Court.
