The Gauhati High Court has recently issued notice on a PIL alleging violation of the existing law laid down in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 .
The PIL has been filed by a social worker, Tarak Takhe. It has been pleaded that the land acquired is in connection with a power project and illegality has been done to benefit private respondents.
J. Roy, the counsel for the petitioner, further submitted that there was no social impact assessment study done which is the necessity under Sections 4 and 7 of the Act of 2013.
The Itanagar Bench of Justice Sanjay Kumar Medhi and Justice Robin Phukan while considering the PIL issued notice to the respondents.
