Gauhati High Court directs Revenue department to consider creation of pond under Amrit Sarovar Yojana

The Gauhati High Court has directed the Commissioner and Secretary to the Revenue Department to consider the representation of petitioners for creation of a pond under the Amrit Sarovar Yojana.

The Division Bench of Justice Rashmin Manharbhai Chhaya and Justice Soumitra Saikia disposed of a PIL filed by the petitioners posing to be public spirited citizens.

The petition filed before the High Court  sought whether the land in question under Dag No.370 under Hojai Revenue Circle could be used for the purpose of creation of a pond under Amrit Sarovar Yojana or not.

The Bench found that the petitioners along with other persons have approached the respondent authorities by way of a representation dated 11.08.2022.

The Court found that the said representation has been addressed to the Deputy Commissioner, Hojai District, Sankardev Nagar, Hojai. The petitioner shall file further detailed representation to the Commissioner & Secretary to the Revenue Department, State of Assam within a period of one week, asked the Court.

It directed the Commissioner and Secretary to the Revenue Department to consider the representation filed by the petitioners, along with the representation dated 11.8.2022 filed before the Deputy Commissioner, Hojai district in accordance with law as expeditiously as possible not later than two weeks from the date of receipt of such representation. 

It is, however, clarified that personal hearing would be necessary and the  Commissioner & Secretary to the Revenue Department shall communicate the order to the petitioners at the address mentioned in the petition.With this observation, this petition was disposed of by the Court.
