Goonda tax:Allahabad High Court grants conditional bail to Basant Yadav

The Allahabad High Court has granted conditional bail to Basant Yadav, accused of hurling wild abuses and demanding goonda tax telephonically.

A Single Bench of Justice Sadhna Rani (Thakur) passed this order while hearing a Criminal Misc Bail Application filed by Basant Yadav.

The accused- applicant is involved in Case under Sections 386, 504, 507 I.P.C, Police Station Dhoomanganj, District- Prayagraj.

It is argued by the counsel for the applicant that there is allegation against the applicant of hurling wild abuses and demanding goonda tax telephonically. Mobile number mentioned in the FIR does not belong to the applicant.

There is also an allegation that if the goonda tax is not given to the applicant, he would eliminate the first informant and his nephew.

It is submitted that there is no witness of the incident. No amount of ransom has been disclosed in the FIR. Consequent to the demand no money has been paid to the applicant.

Criminal history of 13 cases has been well explained in the affidavit filed in support of bail application. The applicant has been languishing in jail since 16.6.2023.

“From the perusal of the record, it is found that there is allegation of demanding ransom, hurling wild abuses and giving threat of life to the first informant telephonically and it is alleged that voice on telephone was of the applicant. It is admitted that previously also two cases of the same nature were filed by the first informant against the applicant.

In the FIR neither the amount of ransom has been disclosed nor any amount has been paid as a result of demand in the FIR. Criminal history of 13 cases is found well explained in the affidavit filed in support of bail application. The applicant has been languishing in jail since 16.6.2023.

Perusing the record, considering the facts and circumstances of the case, the nature of allegations, arguments advanced by the counsel for the parties and without expressing any opinion on the merit of the case, I find it to be a fit case for bail”, the Court observed while allowing the bail application.

The Court ordered that,

Let the applicant Basant Yadav who is involved in aforesaid crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions.

1. The applicant will attend and co-operate the trial proceedings pending before the court concerned on the dates fixed after release.

2. He will not tamper with the witnesses.

3. He will not indulge in any illegal activities during the bail period. The identity, status and residential proof of sureties will be verified by the court concerned and in case of breach of any of the above conditions, the trial court shall be at liberty to cancel the bail and send the applicant to the prison.
