Gujarat High Court dismisses 2018 PIL over lack of petitioner interest in it

The Gujarat High Court has dismissed a public interest litigation (PIL) filed in 2018, citing the petitioners’ lack of vigilance in pursuing the case. 

The PIL, filed by Ajay Purushottamdas Trivedi and another, raised several issues pertaining to the working of the Ahmedabad Municipal Corporation, including the alleged misuse of strip gardens and service roads.

The court observed that despite the petition being filed over six years ago, the petitioners had not pressed for the issues to be heard, and the case had been adjourned multiple times at the request of the petitioners. 

The court also noted that one of the petitioners had expired, and the other petitioner had not pursued the case diligently.

The court held that it was not possible or permissible for the court to examine the issues raised in the PIL, which were now six years old, especially when the petitioners themselves were not pursuing the case. 

The Division Bench of Chief Justice Sunita Agarwal and Justice Pranav Trivedi dismissed the PIL, citing the petitioners’ lack of vigilance and diligence in pursuing the case.
