The Gujarat High Court dismissed a Public Interest Litigation (PIL) filed by a person, who was aggrieved/annoyed by the syllabus introduced by the State Government in a local school, which requires introduction, adoption and implementation of Gujlish project.
The PIL has been filed by one Priyesh S Patel.
The averments made in the petition are in the nature of raising personal grievances by the petitioner, who was not happy with the syllabus introduced in the school wherein his daughter was studying.
The Division Bench of Chief Justice Sunita Agarwal and Justice Aniruddha P. Mayee noted that the policy was introduced in the academic year 2015-16. The petition in the nature of PIL has been filed in the year 2021. However, when the matter was taken up, it was submitted by the counsel for the petitioner that the petitioner has withdrawn his daughter from the school wherein she was studying and wherein this policy has been introduced.
Taking note of the above facts, the Bench observed that it is only the anguish of the petitioner which is the reason for filing of instant PIL. It is settled law that a public interest litigation, wherein personal grievances are being raised, cannot be entertained. The present petition is being dismissed as not maintainable by the High Court.
