Gujarat High Court disposes of PIL against aghori, witchcraft practices

The Gujarat High Court disposed of a Public Interest Litigation (PIL) filed against unlawful and inhuman practices going on in the State of Gujarat, which had resulted in victimisation of persons falling prey to unlawful practices such as aghori, witchcraft, tantrik, etc.

In compliance of the order dated 12.07.2024 passed by the High Court, the Government Pleader has brought before the Court a copy of the legislation promulgated by the State Government known as Gujarat Prevention and Eradication of Human Sacrifice and Other Inhuman, Evil and Aghori Practices and Black Magic Act, 2024, which has been notified in the Gujarat Government Gazette dated 02.09.2024. 

Section 11 of the said Act provides for making of the Rule by the State Government to carry out the purposes of the Act.

The Bench expected that the Rules to carry out the purposes of the Act in accordance with Section 11 would be framed and promulgated within the shortest possible time. 

“We also require that the State Government shall give due publicity to provisions of the Act and the Rules made thereunder through all means such as social media handle of the State Government, print and electronic media, such as newspapers, Doordarshan etc. over a sufficient period of time so that people of the State be aware of the protection granted to them under the Act.”

With the hope and trust that the provisions of the Act would be implemented by the Executive Authority in its true letter and spirit, the Division Bench of Chief Justice Sunita Agarwal and Justice Pranav Trivedi laid the petition to rest.
