The Gujarat High Court recently disposed of a Public Interest Litigation (PIL) filed in 2024, relating to the registration of clinical establishments in the state.
The Division Bench of Chief Justice Sunita Agarwal and Justice Pranav Trivedi took note of the progress made by the state government in implementing the Gujarat Clinical Establishments (Registration and Regulation) Act, 2021, and the rules framed thereunder in 2024.
According to the affidavit filed by the Under Secretary, Health and Family Welfare Department, Government of Gujarat, the selection and appointment process of the remaining members of the District Registering Authority was complete, and the authority was established for each district in the state for the registration of clinical establishments.
The court was informed that around 14,000 applications for provisional registration had been received, and as of the date of the order, 12,403 clinical establishments had been provisionally registered within the state.
Considering the progress made, the court found no reason to keep the PIL pending and disposed of the petition.
However, the court observed that the competent authority should ensure strict implementation of the Act and the rules framed thereunder by undertaking the necessary processes.
