Gujarat High Court dismisses PIL seeking live streaming of Gujarat Information Commission proceedings

The Gujarat High Court dismissed a Public Interest Litigation (PIL) filed seeking direction to respondent authority to start the proceedings of the Gujarat Information Commission on live-streaming or live telecast on the appropriate electronic platform in the interest of justice.

The petitioners  (two in number) claim to be the RTI Activists associated with RTI Ekta Manch. They are seeking for a direction in the nature of mandamus, commanding the Gujarat Information Commission to live-stream or live-telecast on an appropriate electronic platform, its proceedings so as to bring transparency in the procedure adopted by them.
From the material brought on record, the Division Bench of Chief Justice Sunita Agarwal and Justice N.V.Anjaria noted that some process have been initiated and information in this regard has been received by the petitioner.

Be that as it may, live-streaming is a matter of policy and would require infrastructure. The Court cannot mandate for live-streaming by issuance of positive mandamus. No cause has been espoused before us which will require interference of this Court for the larger public interest”, the Court observed.

“The present Writ Petition (PIL) is accordingly dismissed. It is open for the petitioner to seek information about the progress in the matter by moving a proper application”, the order reads.
