The Uttarakhand High Court has directed all respondent authorities, including the Pey Jal Nigam, to ensure the repair work of the road in Haldwani is undertaken without any delay whatsoever.
The Division Bench of Chief Justice Vipin Sanghi and Justice Ramesh Chandra Khulbe issued notice on a Public Interest Litigation (PIL) on the highly dilapidated condition of the road in Haldwani.
Upon submissions being made by Ashish Joshi, counsel, who appeared for Municipal Commissioner/Mukhya Nagar Adhikari, Nagar Nigam, Haldwani-Kathgodam, that the Pey Jal Nigam has been defrayed the funds for not only carrying out the sewer work but also for repair of the road affected due to the said work, the Bench called upon D.S. Patni, Senior Counsel, appearing for the Pey Jal Nigam, to appear and accept notice.
The petitioner has placed on record some photographs, which display the present condition of the road in question, in Haldwani. The same is in a highly dilapidated condition. The High Court also found that debris has collected along the road at several places, apart from there being gaping holes, in which water is collecting.
“Such a situation cannot be countenanced. We, therefore, direct all the respondent authorities, whomsoever responsible it is, including the Pey Jal Nigam to ensure that the repair work of the road is undertaking without any delay whatsoever,” the Court directed.
Further, the Court directed that an Action Taken Report shall be placed before the Court on or before the next date of August 4.
“The Executive Heads of the concerned Department(s) shall be personally responsible to ensure compliance of this order, failing which, we shall be compelled to take a serious view of the matter,” the Court observed.
