Himachal Pradesh High Court orders transfer of govt employee from tribal area upon finishing tenure

Petitioner Kalpana Sharma had filed a petition seeking directions to the concerned authority to transfer the petitioner from tribal area of Killar, Tehsil Pangi, District Chamba, to any station of her choice or to any other vacant station nearby her home, without waiting for any substitute.

The Himachal Pradesh High Court has ordered the transfer of a government employee from a tribal area to other areas on completion of her tenure.

Disposing of the petition, the Division Bench of Justice Tarlok Singh Chauhan and Justice Chander Bhusan Barowalia observed that the petitioner has completed more than normal tenure of service in the tribal area and, therefore, in terms of transfer policy, she is entitled to be transferred to a soft area or stations of her choice.

The court further observed yesterday: “However, perusal of the representation reveals that the petitioner has only mentioned three stations of her choice, whereas, she was required to give five stations of her choice, one of which shall essentially be outside her home district.”

The Bench while disposing of the petition permitted the petitioner to file a representation within a week. “In the event of the petitioner making a representation within the stipulated period, the respondents shall consider and decide the same by passing consequential order of her transfer within a further period of two weeks,” the order reads.
