The Russian national Mikhail Shargin, who was accused of involvement in the Joint Entrance Exam (JEE) scam which took place in 2021 has been granted bail by the Rouse Avenue Court Delhi.
The matter was presented before Special Judge Dig Vinay Singh who said that there is no provision for refusing bail to someone ,just because he is a foreigner.
The Court also said that the passport of Mikail is already in possession of the Central Bureau of Investigation (CBI).
As per the court, this case would go on for long and Mikhail cannot be hold so long and should be granted bail. The Court also added that Mikhail deserves to be released on bail as he had already spent almost a month in custody.
Another reason that Court gave for granting bail was that all the co accused in the JEE Scam have been granted bail long back. The Court has granted bail with 2 sureties and a bond of Rs. 1 lakh.
The accused in JEE scam , was arrested on October 3, and remained in police custody for a week and was later sent to the judicial custody.
As per the records, Mikhail has been alleged to have tampered with the software for the 2021 JEE Main examination along with hacking the system.
The Lawyer who represented Mikhail argued before that the Court has not approved the bail on a mere reason that he isa foreigner and can flee. whereas all the other 23 co-accused have been granted bail and Mikhail too should be granted bail accordingly.
The reason for CBI to oppose bail was that Mikhail is the mastermind and was instrumental in hacking the software.
As rightly thought, CBI agrees that Mikhail being a foreign National will never be available for trials and will leave the country or worst still again indulge in such practice.
