The Karnataka High Court has disposed of a Public Interest Litigation (PIL) filed seeking direction to the Respondents to implement the provisions of Pharmacy Act & Drugs and Cosmetics Act 1940 & Rules 1945 as per the procedure laid down therein.
The PIL filed by Ashok Swamy Heroor further seeks direction to the Respondent State to appoint commission of inquiry u/s.45(5) of the Pharmacy Act 1948 to take needful action as provided under Law.
During the course of the proceedings pending in the High Court, several directions were issued from time to time.
The Division Bench of Chief Justice Ritu Raj Awasthi and Justice Ashok S. Kanagi observed that respondents were required to notify the Draft Rules of the Karnataka State Pharmacy Council (Amendment) Rules, 2022.
The memo of compliance dated 07.06.2022 has been filed enclosing therein the notification dated 06.06.2022 wherein, the Karnataka State Pharmacy Council (Amendment) Rules, 2022 have been notified.

In view of the above, the Court is of the considered view that the requirement of the provisions of the Pharmacy Act and Drugs and Cosmetics Act 1940 and Rules 1945 have been complied with. In case the petitioner wants any clarification regarding the Rules which have been notified by the State Government, they are at liberty to do so, the Court directed.
