The Kerala High Court dismissed a Public Interest Litigation (PIL) filed challenging the validity of a statutory provision related to a user fee.
The petitioners, Unnikrishnan and Manoj K., residents of Balussery, Kozhikode, argued against the imposition of the user fee.
However, the court held that individuals affected by the user fee can challenge its validity, rendering the PIL unnecessary.
The petitioners’ counsel pointed out that the ordinance has been converted into a statute, which needs to be challenged.
Despite this, the Division Bench comprising Chief Justice Nitin Jamdar and Justice S. Manu disposed of the PIL, citing its earlier observation.
