Kerala High Court disposes of PIL on safe transport of radioactive material

The Kerala High Court has disposed of a Public Interest Litigation (PIL) filed by a by a practising advocate with data sourced from the public domain on the safe transport of radioactive material published by the Atomic Energy Regulatory Board, Mumbai.

However, during the hearing, the bench of Chief Justice Nitin Jamdar and Justic S. Manu observed that the petitioner lacked expertise in the subjects involved, including mining and atomic energy.

The court was left with only papers from the public domain with no assistance from the petitioner.

The Senior Government Pleader also placed on record a decision of the Division Bench of the court in a similar case, which had already looked into the issues raised.

Considering the nature of the issue and the lack of expertise on the part of the petitioner, the court decided to forward the petition to the Chief Secretary of the State.

The Chief Secretary has been directed to examine the petition and forward it to the concerned Secretary of the Department.

The concerned Secretary was then required to take a necessary decision after examining the issue raised by the petitioner and the decision of the Division Bench of the court.

With this direction, the PIL was disposed of.
