Kerala High Court disposes of PIL over flyover in Kollam district

The Kerala High Court, comprising Chief Justice Nitin Jamdar and Justice S. Manu, disposed of a Public Interest Litigation (PIL) filed by residents of Ayiroor Village in Varkala, regarding the construction of a flyover at Parippally Junction in Kollam District.

The petitioners, Sivajith S. and Sindhu, sought directions for constructing five spans below the flyover from the junction to Kollam. 

However, the Project Director of the National Highways Authority of India (NHAI) submitted a counter stating that a committee, constituted by the Competent Authority, recommended a three-span flyover (size 3*35m) instead of the initially proposed two-span flyover.

The committee’s decision was made after considering public representations, agitation, and VIP references. 

Approximately 50% of the work has been completed, and changing the design and drawings at this stage would not be technically feasible or financially viable.

The counsel for the petitioners stated that the cause raised in the PIL stands redressed, leading to the disposal of the petition. 

The court clarified that the disposal was based on the counter submitted by the respondents, without examining the merits of the proposed steps.
