Kerala High Court issues notice to Kozhikode District Collector on petition seeking removal of unauthorised flex hoarding in Cherupuzha river

The Kerala High Court has issued notice to Kozhikode District Collector, others on a petition filed by an Advocate, being aggrieved by the inaction on part of the respondents in not taking any effective measures to remove the unauthorised hoarding of flex in Cherupuzha (River), Kuragattukadavu.

Reliefs sought for in the petition are as follows: 

1. to issue a writ in the nature of mandamus or such other writ, order or direction directing the District Collector , Kozhikode (Respondent 2) , Koduvally Municipality (Respondent 4) , Chathamangalam Panchayat (Respondent 6) to remove the illegal encroachments and unauthorized hoarding of flex in Cherupuzha River, Pullavoor, Kuragattukadavu within a time frame to be fixed by the High Court. 

2. To issue a writ in the nature of mandamus or such other writ, order or direction directing the 2nd and Regional Joint Director , Department of Urban Affairs (Respondent 3) to take legal action against those persons who erected the unauthorised and illegal hoardings in the river. 

3. to issue a writ in the nature of mandamus or such other writ, order or direction directing the 2nd respondent to consider and pass order on  complaint submitted by the petitioner within a time frame to be fixed by the High Court. 

4. To issue a writ in the nature of mandamus or such other writ, order or direction directing the 3rd respondent to consider and pass order on  complaint submitted by the petitioner within a time frame to be fixed by the Court.

While considering the plea, the Division Bench of Chief Justice S. Manikumar and Justice Shaji P. Chaly issued notice to the respondents and directed the Senior Government Pleader to get instructions as to whether the Government have issued any orders for removal of hoardings.
