The Allahabad High Court has today agreed to hear the petition seeking transfer of case related to the Krishna Janmabhoomi-Shahi Idgah Masjid dispute on March 2.
The Single-Judge Bench of Justice Nalin Kumar Srivastava, while issuing notice to the opposite parties number 2, 3 and 4, directed them to file a reply before February 28.
The transfer plea filed by the Hindu side contended that the issues in the case concerned crores of devotees of Lord Krishna and that the matter was of national importance. It further said that the case included substantial questions of law and several issues relating to the interpretation of the Constitution.
It said following the initial suit being filed in the Court of Civil Judge Senior Division at Mathura, a number of suits were filed copying verbatim, the contents of the initial petition.
The subject matter of all these petitions, apart from the relief sought in them, was of similar nature, noted the Hindu side.
It further sought transfer of all cases to the Mathura District Judge, in order to avoid the possibility of multiple verdicts on similar issues.
The transfer petition was opposed by the Waqf Board on the ground that it was not maintainable. The Board argued that an application should have been moved before the Chief Justice of the High Court instead.
