The Allahabad High Court has dismissed the petition, refusing to grant relief to MLA Mukhtar Ansari’s wife Afshan Ansari in the land grab case.
The Division Bench of Justice Ashwani Kumar Mishra and Justice Rajnish Kumar passed this order while hearing a petition filed by Smt Afshan Ansari.
In a challenge laid to the FIR at the instance of co-accused being Criminal Misc Writ Petition, a coordinate bench of the Court has already dismissed the writ petition subject to the right of the petitioner therein to apply for bail, the Court noted.
“A specific finding has been recorded in the First Information Report since discloses the offence and it can not be quashed. We do not find any good reason to take a different view as the same F.I.R is under challenge in the writ petition”, the Court observed.
Prayer for quashing the F.I.R is declined and the writ petition is, accordingly, dismissed, the Court ordered.
An FIR has been registered against Afshan Ansari under the UP Gangster and Anti Social Activities (Prevention) Act on 31 January 2022 at Dakhin Tola police station in Mau.
