Letter to CJI: Murder charge against UP police needed for killing of gangster Vikas Dubey

Atal Bihari Dubey an Advocate practicing in the Bombay High Court, has written a letter addressed to the Chief Justice of India S. A. Bobde requesting to take suo motu cognizance of the fake encounter of Vikas Dubey with a direction to transfer the case to Central Bureau of Investigation (CBI) under the observation of a retired Judge of the Supreme Court.

The Advocate has further requested the CJI for directions to register an FIR against the police officers involved in the encounter of Vikas Dubey under Section 302 (murder) of the Indian Penal Code.

Yesterday, Gangster Vikas Dubey was killed in an ‘encounter’ with Uttar Pradesh Police when he was allegedly trying to escape after snatching a gun from the police. According to the police, when they asked him to surrender he shot at the police, and in the counter attacked he was killed.

Atal Bihari Dubey has stated that they were fearing that Vikas Dubey would be killed by the UP police in the same manner as the other accused were killed in the Kanpur police murder case. “Unfortunately, the police has done the same act and murdered Vikas Dubey and didn’t follow guideline issued by this Hon’ble court in the PUSL Vs State of Maharashtra matter,” stated Atal Bihari Dubey.

Calling the incident a violation of rule of law and constitutional guarantee, the advocate further questions: “Is the satisfying of collective conscience in such a brazenly unlawful and murderous way healthy for democracy?”
