Allahabad High Court permits inmate to appear for LLB 1st semester from prison

The Allahabad High Court has allowed a jailed person to appear in the LLB first semester examination in police custody.

The Division Bench of Justice Attau Rahman Masoodi and Justice Narendra Kumar Johari passed this order while hearing a petition filed by Anjani Kumar Shukla.

The petitioner is a student of LL.B first semester enrolled in Rajendra Singh (Rajju Bhaiya) University, Prayagraj, UP.

He relied on an undated certificate, which showed that the university was satisfied with the requisite attendance criteria of the student.

Subject to satisfaction of the requisite attendance, the Court directed that the petitioner may be facilitated to appear in the LLB first Semester examination scheduled on 12.3.2022, 14.3.2022, 16.3.2022, 22.3.2022, 24.3.2022 and 26.3.2022 or any other date to which the examination may be re-scheduled in respect of these papers by the University under the custody of the jail authority with due intimation to the District Magistrate.

“The District Magistrate shall make due arrangement of the petitioner’s participation in the examination scheduled on the aforesaid dates under the police custody for the requisite period from the beginning of examination up to its end. The petitioner shall be brought to the examination centre for his participation therein and re-lodged in jail after the examination is over ”

-the order reads.

The Court has fixed the next hearing of the petition on April 04, 2022.

The student is in jail for being an accused in the FIR registered under sections 302 and 427 of the Indian Penal Code (IPC).
