Madangir liquor vend: Delhi HC seeks responses from Delhi govt, Excise Commissioner, Delhi Police chief

The Delhi High Court on Friday sought responses from the Delhi Government, the Excise Commissioner and the Delhi Police Commissioner among others in a plea seeking the revocation of liquor license granted for operating a liquor vend in a residential neighbourhood in Delhi’s Madangir.

The single-judge bench of Justice V. Kameswar Rao issued notice in the petition moved by the Residents’ Welfare Association of the area and listed it before the Registrar on March 4, 2022.

Filed by Advocates Ashutosh Kumar Mishra and Misbahul Haque on behalf of DDA Flats Residents’ Welfare Association of Pushp Enclave in Madangir, the main grievance of the petitioner association is that the issuance of license to the liquor vend in question has been made without proper inspection and is in contravention of the Delhi Excise Act and Delhi Excise Rules, 2021, as it falls within prohibited distance from a coaching centre, religious place and a hospital.

“Most of the shops in the said commercial street relate to catering of domestic needs….and thus, opening of a wine and liquor shop in this commercial street is not conducive for the residential environment,” reads the plea. The plea contended that the vend, which operates on the ground and the first floor, is in violation of the master plan as the first floor of the building is non-commercial in nature. It is further contended that the occupant of the said vend has been carrying out unauthorized construction and causing traffic congestion in the locality.

The plea highlighted that a representation was made to the concerned authorities seeking cancellation of the license of the liquor vend, however no action has been taken till date. In light of the above, the plea prays for restraining the opening of liquor vends in the said complex which is in the vicinity of a residential surrounding.
