Madhya Pradesh HC disposes petition filed against encroachment in Katni

The Madhya Pradesh High Court on Monday disposed of a petition against an encroachment in the new settlement of Katni.

The division bench of Chief Justice Mohammad Rafiq and Justice Sanjay Yadav said in their order that the Municipal Corporation has initiated action in the case. Therefore, the case cannot be interfered with. The high court has also granted liberty to approach the Executive Engineer of the Municipal Corporation of Katni in this case.

The public interest litigation filed by Dr Rupa Lalwani, a resident of Katni Nai Basti, stated that Pritam Das Rizwani has encroached on her land. A complaint was made to the Commissioner of the Municipal Corporation of Katni. The Municipal Corporation had issued a condolence notice to Anavedka on August 6, 2020, but no action was taken thereafter.

Advocate Saurabh Sharma, the counsel for the petitioner, argued that the encroachment is not being removed even after the complaint.

After the hearing, the high court said action is being taken by the Municipal Corporation regarding removal of the encroachment, so the case cannot be interfered with.

“Having regard to the fact that the Municipal Corporation, Katni is
already taking steps to ascertain as to what is the nature of the possession of opposite party No.7 on the disputed land and has called upon him to produce his title documents, this court does not deem it appropriate to entertain the matter, however, with the observation that the petitioner is always at liberty to approach the Executive Engineer, Municipal Corporation, Katni for redressal
of her grievance, the writ petition stands disposed of,” the order reads in conclusion.
