Madhya Pradesh HC dismisses PIL imposes cost of Rs 10,000 for wasting time of court, registry

The Madhya Pradesh High Court dismissed a Public Interest Litigation (PIL) and imposed a cost of Rs 10,000 on the petitioner for wasting the time of the High Court.

The PIL questioned the allotment of land by the respondents for establishment of Common Bio Medical Waste Management Facility.   

Thereafter, an application has been filed seeking withdrawal of the PIL. 

“There is not a single reason assigned as to why the petitioner wants to withdraw this petition,” observed the High Court.
The Division Bench of Chief Justice Ravi Malimath and Justice Vishal Mishra  failed to understand as to how this petition could be filed and withdrawn at the whims and fancies of the petitioner. 

“So much of Court’s as well as Registry’s time is spent in dealing with the petitions only because public interests are involved. We do not think that this kind of conduct should be appreciated,” the Court remarked.

Therefore the petition is dismissed as withdrawn  with a cost of Rs 10,000 to be paid by the petitioner with the MP High Court Employees Association, Jabalpur within 15 days, the Court ordered.
