Madhya Pradesh HC disposes of PIL seeking enquiry against respondents for corruption

Rajmani Singroul, the counsel for the petitioner, submitted that the allegations raised in this petition for corruption and misappropriation on the part of the respondents for which the Petitioner can very well approach the Lokayukt Organisation by filing an appropriate complaint before the competent authority under the MP Lokayukta Evam Up-Lokayukt Adhiniyam, 1981.

The Madhya Pradesh High Court has disposed of a PIL seeking enquiry against the respondents in respect of corruption and misappropriation on their part.

The PIL has been  filed by one Rammilan Sharma seeking a direction to initiate enquiry against the respondents on a complaint of the petitioner in respect of corruption and misappropriation on their part. The petitioner has also prayed for a direction to consider and decide the representation of the petitioner in accordance with law.

Rajmani Singroul, the counsel for the petitioner, submitted that the allegations raised in this petition for corruption and misappropriation on the part of the respondents for which the Petitioner can very well approach the Lokayukt Organisation by filing an appropriate complaint before the competent authority under the MP Lokayukta Evam Up-Lokayukt Adhiniyam, 1981.

Counsel for the State relying on the judgment passed by the Division Bench in the case of Kanhaiya Lal Vishwakarma vs State of MP, 2011 ILR 124 submitted  that such kind of complaint ought not be entertained in the PIL and should be left for the competent authority to dwell into.

The Jabalpur Division Bench of Chief Justice Mohammad Rafiq and Justice Vijay Kumar Shukla  disposed of the PIL with liberty to petitioner to approach Lokayukta in accordance with law, the order read.
