Madhya Pradesh HC tells authorities to decide representation of petitioner within 3 months

Prashant Singh Kaurav, Counsel for the Petitioners, submitted yesterday that Surendra Singh Tomar and others are the employee of the Horticulture Department and providing service on the post of Senior Horticulture Development Officer.

The Madhya Pradesh High Court has directed the concerned authorities to decide the representation of the petitioner within a period of three months seeking grant of benefit of the third-time pay scale to the petitioners on completion of 30 years of service and to pay the differential amount of salary along with interest.

Prashant Singh Kaurav, Counsel for the Petitioners, submitted yesterday that Surendra Singh Tomar and others are the employee of the Horticulture Department and providing service on the post of Senior Horticulture Development Officer.

The petitioners got appointed in the department on October 28, 1989 and November 17, 1989. Benefit of first time pay scale was extended to the Petitioners and thereafter, benefit of second time pay scale was extended to petitioners w.e.f. 30.11.2009. The Petitioners became eligible for the benefit of third time pay scale , claimed the Counsel.

It was alleged that similarly situated persons were considered and benefit of third time pay scale was extended , PB 3-15600-39100+6600 Grade Pay. As the petitioners are eligible and have completed the period of 30 years, despite of which, benefit of third time pay scale has not been provided to the Petitioners.

Govt. Advocate for the State has no objection to the innocuous prayer made by the Counsel for the Petitioners. If fresh representation is filed by the petitioners, the same shall be decided as early as possible.

A Single Bench of Justice Vishal Mishra onsidering the overall facts and circumstances of the case , dispose the Petition with a direction to the Petitioners to submit a fresh detailed representation alongwith all the relevant documents within a period of seven working days to the Concerned Authorities and in turn the Concerned Authorities “is directed to dwell upon the representation submitted by the petitioners and decide the same within a period of three months from the date of receipt of the certified copy of this order”, the order read.
