Madhya Pradesh High Court directs authority concerned to look into allegations regarding appointment of Assistant Professors in Gwalior college

The Madhya Pradesh High Court has directed the appointing authority of private respondents to consider the grievance raised by the petitioner, alleging that certain appointments on the post of Assistant Professors in different disciplines in the G.R. Medical College, Gwalior, have been made on the basis of fake/forged experience certificates.

The Gwalior Bench comprising Justices Sheel Nagu and Deepak Kumar Agrawal passed the order on October 4 on a PIL filed by one Ashish Rai, seeking the following reliefs:-

“(i) The high-level inquiry may kindly be ordered to find out the truth and to make sure the appointment of the eligible persons for the post of Demonstrator, Junior Resident, Senior Resident, Assistant Professor in the G.R. Medical College, Gwalior.

(ii) The respondents may kindly be directed to calibrate the investigation concerning experience certificate, which had been tendered by appointment on different posts in the G.R. Medical College, and, if such certificates are found to be forged, then an FIR may be ordered against them.

(iii) Against the private respondent namely Dr. Roop Sharma recovery of the amount for the period for which he had worked in the G.R. Medical College, Gwalior may kindly be ordered including the F.I.R.

(iv) Any other order or direction, which this Court may deem fit and proper in the facts and circumstances of the case.

(iv) Costs of the petition may also be awarded to the petitioner.”

The Bench held that since the issue involves disputed questions of fact, it would be appropriate that disciplinary authority deals with the said aspect of legality and validity of the appointments from the point of view of the experience certificates filed by the private respondents.

Accordingly, the Court without entering into the merits of the matter, disposed of the PIL with directions to the appointing authority of private respondents to consider the grievances raised by the petitioner in various representations, which have been filed cumulatively.

The inquiries will be completed within a period of 60 days from the date of receipt of copy of the order and the compliance report of the directions passed by the High Court shall be filed by appointing authority latest by January 31, 2022, ordered the Bench.
