The Madhya Pradesh High Court recently directed the Collector, District Rewa to conduct a detailed inquiry into encroachments on public land as raised by the petitioner.
The petition has been preferred by the petitioner, Ramanauj Pandey, in the nature of Pro Bono Publico (for the public good) for suitable direction in respect of the removal of encroachment on Public Road and Government property measuring 4.33 acres, Ward No.8, Anand Nagar, Bodabeg, District Rewa.
The petitioner’s contention is that encroachment on land measuring 4.33 acres in various Khasra numbers as mentioned in para 3.5 of the Petition has been made by various persons resulting in reduction of the width of the public road as a result of which general public is suffering difficulties and accidents of daily basis.
Rajkumar Tripathi, Counsel for the Petitioner further submitted that the Petitioner has submitted various representations to Respondents Authorities but no action upon them has been taken.
The Division Bench of Chief Justice Mohammad Rafiq and Justice Pranay Verma upon hearing Counsel for the parties, disposed of the Petition by directing Collector, District Rewa to conduct a detailed enquiry into the matter regarding encroachment over public land as raised by the Petitioner.

“While conducting such enquiry, Collector, District Rewa shall afford due opportunity of hearing to all persons who may be affected by such enquiry as well as to the petitioner. If in such enquiry, Collector finds any encroachment over any Government land having been made by any person, he shall take the necessary steps for removal of such encroachment as per law,” the order reads.
