The Madhya Pradesh High Court has dismissed a plea seeking implementation of laws, rules and guidelines by the competent authorities of the Central Government and the State Government in the context of garbage accumulation in the city of Gwalior.
The Division Bench of Justice Rohit Arya and Justice Milind Ramesh Phadke, while disposing of the petition, observed that the petitioner, being an Advocate, was expected to win the confidence of people of the area by making visits, house to house and spread awareness against throwing out garbage on public streets, lanes and cross-roads.
Upon reading of the petition, the Bench is of the view that though styled as pro bono publico (for the public good), the plea lacks in material particulars as it is primarily based upon some photographs and newspaper cuttings, which in the opinion of the Court, require to be factually ascertained.
Under such circumstances, the Court observed that it cannot be reduced to a fact finding forum, instead, the petitioner shall be well advised to approach respondent authorities seeking indulgence in the matter of garbage accumulation.
“The petitioner being an Advocate, is also expected to win the confidence of people of the area by making visits, house to house and spread awareness against throwing out garbage on public streets, lanes and cross-roads. The petitioner shall undertake the drive and prepare a report in that behalf facilitating indulgence of the competent authorities,” the order read.
