The Madhya Pradesh High Court disposed of a Public Interest Litigation (PIL) seeking direction to install the Global Positioning Devices on each and every vehicle engaged in transportation of food grains for Public Distribution System.
The PIL filed by Akhil Bhartiya Upbhokta Utthan Sangthan (MP) seeke the following reliefs:-
“(i) To issue a writ in the nature of mandamus Hon’ble court may be pleased to direct the respondent to forthwith install the Global Positioning Devices on each and every vehicle engaged in transportation of food grains for Public Distribution System in terms of the Madhya Pradesh Public Distribution Control Order 2009 Clause 7 sub-clause (10).
(ii) To issue a writ in the nature of mandamus Hon’ble court may be pleased to direct the respondent to forthwith install the Global Positioning Devices on each and every vehicle engaged in transportation of food grains for Public Distribution System in Rewa and Satna district.
(iii) To issue a writ in the nature of mandamus Hon’ble court may be pleased to direct the respondent no.1 to set up a committee to enquire the matter and punish the guilty of icers responsible for intentional delay in installation of GPS devices in the vehicles engaged in transportation of food grains.
(iv) Any other order/orders that this Hon’ble Court deems fit for proper in the facts and circumstances of the case may also kindly be passed.”
Reply has been filed by the respondents indicating installation of the global positioning devices on each and every vehicle engaged in transportation of food grains for public distribution system. An additional reply has also been filed today wherein it has been stated that all the vehicles have been fitted with a GPS system.
Petitioner’s counsel being satisfied with the same submits that nothing further survives in the matter for consideration.
In view of the fact of GPS system being installed in every vehicle engaged in public distribution system and the plea of the petitioner having been answered, the Division Bench of Chief Justice Ravi Malimath and Justice Vishal Mishra observed that no further orders are called for.
