The Jabalpur Bench of Madhya Pradesh High Court on July 05, in an interim order, permitted disabled candidates, to appear in the main examination of civil judges to be held on August 13.
The Petitioner, Ritesh Kumar Goel, resident of Dadri, Uttar Pradesh has approached the High Court claiming that a four percent reservation was to be given under the handicapped quota in Madhya Pradesh Civil Judge Examination 2019. Accordingly, 20 posts were reserved for the handicapped quota. No separate merit list for the handicapped quota was prepared after the result of the preliminary examination.
Advocate Shreyas Dubey argued that the handicapped candidate was allowed for the main examination only after bringing the same cut-off marks as the general category. Because of this, only 13 differently-abled candidates were able to qualify for the main examination. Even four percent reservation is not being followed for the inclusion of 13 applicants in the main examination for only 20 seats. It was urged that there is a need to prepare a separate merit list to fill the four percent disability reservation.

The Division Bench of Chief Justice Mohammad Rafiq and Justice Vijay Kumar Shukla after hearing the Counsel for the Petitioner and also taking into consideration the facts of the case directed that the Petitioner be permitted to provisionally appear in the Mains Examination of Civil Judge, Class-II Entry Level, scheduled on 13.08.2021 and shall be entitled to give options to any two out of four centers to appear for the examination on an application to be submitted by e-mail to the Registrar Examination.
“Result of the examination however shall not be declared save with the permission of the Court”, clarified the Court.
