The Madras High Court had dismissed a petition for a Central Bureau of Investigation (CBI) probe into the reasons leading to death of Tamil Nadu Chief Minister J Jayalalithaa.
A Bench of Acting Chief Justice T Raja and Justice D Krishnakumar told the petitioner,to first make representations before the CBI and Central and State government authorities.
In his plea,the petitioner relied on the inquiry report of Justice Arumugasamy Commission and submitted that there were various discrepancies in the death of the former minister.
The report has put various questions and alleged involvement of many people in the conspiracy. The commission also stated that there were lapses in the treatment,as the hospital to disclose the facts relating to her medical condition and the course of treatment.
The commission had found the aide of Jayalalitha’s Sasikala, the former health minister Dr C Vijayabaskar, Dr. KS Sivakumar (Jayalalithaa’s personal physician and relative of Sasikala), and former health secretary Dr J Radhakrishnan guilty. It had asked for an investigation into the former Tamil Nadu chief minister death case.
It was actually after a huge furor, that the then Chief Minister requested a probe into her death which led to the formation of the Arumugasamy Commission. The Commission was assigned to enquire into the circumstances, health condition, and situation leading to the hospitalization of Jayalalitha on 22 September 2016, and treatment provided till her demise on 5 December 2016
The Commission had also held that there were lapses on the part of the hospital where Jayalalithaa was undergoing treatment prior to her death. T
The Commission had found that the doctors at the private hospital had failed to disclose the course of treatment, Gopaljee said in his plea.
While dismissing the petition, the court asked Petitioner R R Gopaljee to exhaust his remedies before the CBI and other concerned authorities by way of representations before approaching the High Court.
