The Bombay High Court Justice CV Bhadang who was hearing the defamation case by Salman Khan has told the Court that he would not be able write the judgement in the case as his retirement approaches.
The retirement of Justice CV Bhadang is due for November 4, 2022, which would put the matter in hold, till the case is allotted to some new judge
Justice Bhadang who will demit the office soon had heard the entire matter in length before he reserved the verdict on the appeal filed by khan on October 11
The judgement on the case was fixed for today, but the counsel informed that he judgment cannot be delivered today due to some important administrative work.
The judge has apologized to everyone related to the case and said that unfortunately he was unable to complete the judgement.
He mentioned as to how he really worked his level best for writing the order but could not complete it, due to the vacation and then administrative work.
He also said that there have been many things which tied him up including some important assignments.
He also said, he would want to apologize to all the parties who invested their time and energy into the case, I would have loved to decide this case either way.
Judge added that it is his misfortune that this came at the fag end of his career and he could’nt do any justice to it.
The dispute began in year 2021 when a civil suit was filed by Khan before the City Civil Court in Mumbai alleging his neighbor making false, disparaging and defamatory allegations in videos, posts and tweets causing harm to Khan, his family members and his business ventures.
In his plea Khan had asked for injunctive reliefs against the defendants, which apart from Kakkad were social media giants like Facebook, Twitter, Google, YouTube and their Indian counterparts.
Khan has asked for an urgent interim relief to restrain defendant from posting any defamatory content against Khan, along with temporary blocking or suspending the media accounts of Kakkad.
The application by Khan was rejected on the basis of documentary evidence that proved the claims made against Khan relating to illegal encroachment and violation of the Forest Act.
With no success from lower court, Khan moved to the High Court by way of the present appeal.
In the High Court, Salman Khan was represented by Senior Advocate Ravi Kadam, who claimed that the content posted against Khan was , was defamatory and communally provocative as well, however the counsel for Kakkad said that their statements were based on real facts, which can be verified.
